SB 1243 -- PUBLIC ADMINISTRATORS
SPONSOR: Wheeler (Byrd)
COMMITTEE ACTION: Voted "do pass by consent" by the Committee on
Judiciary by a vote of 18 to 0.
This bill requires the public administrator of Jackson County,
who is serving as a conservator, to have pooled accounts audited
at least once a year. The audit, which will be paid by the
county, must review all receipts and disbursements and a
certified public accountant must report to the judge about each
account. The bill also defines "pooled account" and specifies
that a fiduciary can place funds into a pooled account only under
certain conditions.
FISCAL NOTE: No impact on state funds in FY 2005, FY 2006, and
FY 2007.
PROPONENTS: Supporters say that the bill allows the public
administrator of Jackson County to have an annual audit of pooled
accounts in the probate court.
Testifying for the bill were Senator Wheeler; and Representative
Meiners.
OPPONENTS: There was no opposition voiced to the committee.
